In short: photographers keep ownership of their photos and set their own prices; we host the galleries, take the payment, keep a commission, and pay out the rest. Customers buy a licence to use the photos personally, not to resell them.
These terms apply when you use Photo Infinity, whether you are buying photos or selling them. By creating an account or buying a photo, you agree to them. If you do not agree, please do not use the service.
You are responsible for what happens under your account and for keeping your password secure. Tell us promptly if you think someone else has access to it. You must give accurate information when you register, and keep it current.
We may suspend or close an account that breaches these terms, is used for fraud, or is used to upload content that is not permitted.
You keep full ownership and copyright in everything you upload. By uploading, you grant us a licence to store your photos, display them in your gallery, and deliver them to customers who buy them. That licence exists so we can run the service, and it ends when you delete the photos — except where we must retain a record of a completed sale.
You are responsible for the content of your galleries. If someone raises a rights or privacy complaint about a photo, we may hide it while we look into it.
You set your own prices, including single-photo prices, bundles, whole-gallery prices and prices by tag. We deduct a platform commission from each sale: currently 5% of single-photo sales and 7% of bundle sales, unless a different rate has been agreed for your account. Card processing fees are also deducted from your earnings. The rates that apply to your account are shown on your dashboard.
Payouts require an active subscription. Sales you make without one, including during a free trial or after a subscription has ended, count toward your earnings in full and are held for you until you subscribe. Where we offer it, you can use your earnings balance to pay for the subscription.
Earnings from a sale become available for payout once the customer's payment has cleared with our payment provider. This is usually two business days after the sale, and can take longer over weekends and bank holidays or if the payment provider holds the payment for review. Until then the sale shows on your payouts page as clearing, with the date it is expected to become available, and you cannot request a payout for it.
Payouts go to the bank account connected through our payment provider, subject to a minimum payout amount shown on your payouts page. Instant transfers, where offered, carry an additional fee that is shown before you confirm.
Where an order contains photos from more than one photographer, each photographer is paid their own share of that order.
Selling features may require a paid subscription or an active trial. Subscriptions renew automatically until cancelled. You can cancel at any time from your subscription page; cancellation stops future renewals and does not refund the current period. If you have chosen to pay your subscription from your earnings balance, we deduct it from your cleared earnings instead of charging your card.
When you buy a photo you receive a personal licence to it. You may print it, keep it, and share it on personal social media. You may not resell it, license it on, or use it commercially without the photographer's written permission.
Your download link is emailed to you after purchase, and if you have an account your downloads are also listed under My Downloads. Links last 30 days from the order and allow up to 5 downloads — whichever runs out first. If a link expires or stops working before you have your photos, contact us and we will sort it out.
Because photos are delivered digitally and immediately, purchases are generally final. We will refund where the files are faulty, where you were charged in error, or where you did not receive what you paid for. Tell us through the contact form and we will look at it.
Do not upload, or use the service to distribute, anything that:
Uploads are screened automatically and may be hidden pending review. We may remove content and close accounts for breaches of this section, and we report illegal material to the appropriate authorities.
We work to keep the service running, but we do not guarantee it will be uninterrupted or error-free. We may change or discontinue features. Where a change materially affects photographers' ability to sell, we will give notice by email.
The service is provided as-is. To the extent the law allows, we are not liable for indirect or consequential losses, or for lost profits or lost data. Nothing here limits liability that cannot lawfully be limited.
We are a marketplace. Disputes about the photographs themselves — their content, quality, or the permissions behind them — are between the customer and the photographer, though we will help where we reasonably can.
If you buy photos, you can close your account at any time from your account settings, under Delete Account. That removes your account and your saved favourites. It does not remove the record of orders you have already placed, which we keep for accounting and tax purposes, and any download links you already hold keep working for the rest of their life.
If you sell photos, you cannot currently close your account from within the site — there are sales, payout and tax records attached to it that we have to deal with properly. Use the contact form and we will handle it for you. Closing a photographer's account removes their galleries from sale, and customers who have already bought photos keep their existing download rights for the remainder of the link's life.
We may update these terms. The date at the top of this page shows when they last changed, and we will tell account holders by email about significant changes. Continuing to use the service after a change means you accept the updated terms.
Questions about these terms go through our contact form.
